Biopatents are patents pertaining to life forms excluding microorganisms. This field of patent is in a very nascent stage whereby a stiff conflict goes on between developed and developing countries. The TRIPS agreement has provided for a balancing approach whereby the developing countries are given freedom to incorporate the terms of the agreement in their laws within definite time frame.
