Konsensuale Erledigungsmethoden sind in der deutschen Strafprozessordnung schon lange kein Randphänomen mehr. Im Gegenteil ¿ in vielerlei Hinsicht dominieren sie den modernen deutschen Strafprozess. Ähnlich wie in Deutschland ist auch in den USA die Hauptverhandlung als zentrale Prozessphase ausgestaltet. Die Prozessrealität zeigt jedoch, dass etwa 97% aller Strafverfahren ohne Hauptverhandlung erledigt werden. Dabei handelt es sich aber nicht um eine systemimmanente Entwicklung, sondern eine seit den 7oer Jahren stattfindende Systemverschiebung. Die funktionale Methode der Rechtsvergleichung erlaubt es strafprozessuale Entwicklungen in Deutschland und den USA anhand ihrer Funktion in der jeweiligen Rechtsordnung zu analysieren, strukturelle Vergleiche zu ziehen und wenn möglich, entsprechende Schlüsse für die deutsche Rechtsordnung zu identifizieren und nutzbar zu machen. Der Fokus der vorliegenden Arbeit liegt nicht auf der viel diskutierten Verfassungsmäßigkeit konsensualer Erledigungsmethoden, sondern auf strukturellen Implikationen, die de facto bereits zu einer Systemverschiebung des Strafprozesses geführt haben. Den Schwerpunkt der Untersuchung bilden hierdurch produzierte oder perpetuierte Diskriminierungseffekte.
