Verwahrentgelten im Einlagengeschäft gegenüber Verbrauchern einen Anwendungsfall eines solchen Anspruchs darstellen könnte. Dabei beleuchtet die Untersuchung zunächst Herkunft, Erscheinungsform und das mit dem Anspruch verfolgte Rechtsschutzziel. Zudem verschafft das Werk einen Überblick über die ergangene Rechtsprechung und untersucht anhand dieser die möglichen Anspruchsvoraussetzungen und Rechtsfolgen. Die Untersuchung der Rechtmäßigkeit der Erhebung von Verwahrentgelten gegenüber Verbrauchern erfolgt anhand deren Qualifikation als Preishaupt- oder Preisnebenabreden sowie einer Unterscheidung zwischen Bestands- und Neukunden. Zuletzt nimmt die Untersuchung die neu geschaffene Abhilfeklage in den Blick und ordnet diese vor dem Hintergrund des untersuchten Folgenbeseitigungsanspruchs ein.
