Das Vertragsrecht übernimmt den Integritätsschutz, der im Grunde durch das Deliktsrecht gewährleistet wird. Der außerdeliktische Integritätsschutz wird seit dem Linoleumrollen-Fall auch durch das Vertragsrecht gewährleistet. Ein Kernproblem war die Haftungslücke in der deliktischen Gehilfenhaftung nach § 831 Abs. 1 S. 2 BGB; der Geschädigte wurde dadurch geschützt, dass das Reichsgericht eine vertragliche Haftung anwandte. Diese Arbeit befasst sich mit den Gründen hierfür und mit der dogmengeschichtlichen Entwicklung außerdeliktischer Schutzpflichten. Im Reformprozess wurde jedoch eine Oppositionsfront gegen den Gesetzgeber aufgebaut. Die deutsche dogmatische Entwicklungsgeschichte ist als Leitfaden für die Reform der deliktischen Gehilfenhaftung im koreanischen ZGB von Bedeutung.
