Um die Anwendung ordnungspolitischer Sachnormen für den internationalen Rechtsverkehr transparenter zu gestalten, werden die Anwendungsvoraussetzungen von Eingriffsnormen im Sinne des Art. 34 EGBGB zunehmend innerhalb bestimmter Rechtsgebiete konkretisiert. Der Verfasser zeigt auf, daß Regelungen des Sozialrechts als international-privatrechtliche Eingriffsnormen charakterisiert werden können. Die Anwendungsvoraussetzungen inländischer sozialrechtlicher Eingriffsnormen werden innerhalb von Fallgruppen exemplarisch anhand einzelner Normen dargestellt. Hinsichtlich ausländischer Sozialrechtsnormen wird zwischen deren Anwendung aufgrund völker- und europarechtlicher Anwendungsgebote sowie aufgrund autonomen Rechts unterschieden.
Der Autor untersucht, wie das französische Recht die Frage nach den schuldnerischen Aufklärungspflichten im Unternehmensinsolvenzverfahren beantwortet. Er stellt zunächst die «procédure de sauvegarde », den «redressement » und die «liquidation judiciaire » vor. Der Autor benennt die dem Schuldner auferlegten Aufklärungshandlungen und zeigt auf, welche Instrumente zur Sanktionierung von Pflichtverletzungen bereitstehen. Für das bessere Verständnis geht er auf die historische Entwicklung seit dem Code de commerce von 1807 ein. Im Falle des Sanierungs- und des Liquidationsverfahrens kommt er zu dem Ergebnis, dass der rechtlichen Missbilligung mangelhafter Sachverhaltsaufklärung nicht mit der Zurückweisung des Eigenantrags Ausdruck verliehen werden kann.
Der Autor dieser Arbeit untersucht umfassend die zentralen Auswirkungen ausländischer Beweissicherungsverfahren auf den Prozess im Inland (Hemmung der Verjährung, entgegenstehende Rechtshängigkeit, Verwertbarkeit der Ergebnisse). Dogmatisch handelt es sich um eine Frage der internationalprivatrechtlichen Substitution. Zunächst ermöglicht die Darstellung exemplarisch ausgewählter europäischer Beweissicherungsverfahren einen Überblick über deren Diversität. Die Arbeit behandelt sodann die internationale Zuständigkeit und erarbeitet die allgemeinen und besonderen Voraussetzungen, die ein ausländisches selbständiges Beweisverfahren erfüllen muss, um im Inland berücksichtigt werden zu können.
Die Konzepte des Eigentumstransfers unterscheiden sich im deutschen und schwedischen Recht grundlegend. Im Gegensatz zum deutschen wird das Eigentum im schwedischen Recht funktional betrachtet. Diese Arbeit untersucht, was dies genau beinhaltet und was daraus fur den rechtsgeschaftlichen Erwerb und den Schutz des Eigentums an Mobilien folgt.
Grenzuberschreitende Gesundheitsleistungen gewinnen mit der wachsenden Zahl jahrlicher Touristenstrome an Bedeutung. Damit einher geht auch die Haufung grenzuberschreitender Arzthaftungsfalle, die das internationale Privatrecht vor neue Probleme stellt. Die Studie vergleicht die Regelungen der Rom I- und Rom II-Verordnungen mit denen des US-Rechts.
