Obwohl im Strafverfahren gegen den ausgebliebenen Angeklagten grundsätzlich keine Hauptverhandlung stattfindet, erlaubt § 329 StPO die Verwerfung der Berufung des Angeklagten und die Verhandlung in dessen Abwesenheit. Nach überwiegender Auffassung verwirkt der Angeklagte insoweit seine Mitwirkungsrechte, weil in seinem unentschuldigten Ausbleiben ein unzulässiger Verzicht auf seinen Anspruch auf rechtliches Gehör (Art. 103 Abs. 1 GG) liegen soll. Dieses Grundrecht garantiert aber die Subjektstellung des Angeklagten schlechthin. Es gibt ihm daher auch das Recht, auf seinen Anspruch auf rechtliches Gehör zu verzichten. Die Untersuchung zeigt, daß die mit § 329 StPO einhergehende Beschränkung dieses Grundrechtsgebrauchs weder auf grundrechtsimmanente Begrenzungen noch höherrangige Rechtsgüter gestützt werden kann. Gegen die Vorschrift sind somit verfassungsrechtliche Bedenken zu erheben.
