This book provides a comprehensive basis for the contractual transfer of immovables under Kosovo law. In particular, it aims to bring near the readers the influence of contract law rules in the transfer of immovables.
This study examines the principle party autonomy as provided for in the European Rome I Regulation and the Rome II Regulation. It critically reflects on the position of the freedom to choose the law in contract and tort in the common law jurisdictions of Australia, New Zealand, Canada and Singapore. It calls to reform the common law approach.
The aim of this study is to examine the substantive applicable law in different arbitral tribunals, especially ICSID and Iran-US Claims Tribunal. Additionally it examines the role of international law and whether it has supremacy over national laws.
