Die Arbeit untersucht, inwieweit die zivilrechtliche Rechtsfigur des Rechtsmissbrauchs in der betrieblichen Mitbestimmung Anwendung finden kann. Zu Beginn erfolgt eine Systematisierung der zivilrechtlichen Rechtsmissbrauchslehre. Die Übertragung dieses zivilrechtlichen Missbrauchstatbestandes in das Betriebsverfassungsrecht erfordert eine Untersuchung des Rechtsverhältnisses zwischen Arbeitgeber, Betriebsrat und Arbeitnehmern. Ausgehend von dieser Klassifizierung wird dann die Übertragung in das Betriebsverfassungsrecht vorgenommen. Die Prüfung der Anwendbarkeit des Rechtsmissbrauchs in der Betriebsverfassung ermöglicht im Anschluss eine Auseinandersetzung mit der betriebsverfassungsrechtlichen Rechtsfolge des Rechtsmissbrauchs. Dabei werden durchgängig Bezüge für die Rechtspraxis hergestellt.

Constitutional consciousness belongs not solely to the legal field, but also to other social sciences. It refers not only to constitutional and national identity but also to European identity, as the general principles of EU law derive from common constitutional traditions. Its low level results with difficulties in the proper reading of the legitimacy of power and with the recently widely discussed democratic deficit both in member states and in the EU itself. The publication addresses the issue of European integration and the common catalogue of values and human rights. The aim is to point out that increasing its level in society shall bring remedy for the democratic deficit in the EU and strengthen respect for fundamental rights. This thesis gives the publication an innovative Character.

Über vierzig Jahre lang brachte Willis Conover ab den 1950er Jahren allabendlich den Jazz via Kurzwelle in die Welt. Besonders in den ehemaligen Ostblockländern wurden Conover und seine Sendungen zu einem Mythos. Während die Kulturpolitiker beider Seiten versuchten, Jazz als Propagandawaffe zu nutzen oder ihn zu bekämpfen, bildeten die entstehenden Jazzkontakte eine wichtige kulturelle Brücke zwischen Ost und West. Diese Doppelfunktion des Jazz als Waffe oder Brücke analysiert das Werk anhand von bislang ungenutztem Archivmaterial aus den USA, Russland und den wichtigsten ehemaligen Ostblockstaaten sowie Conovers Nachlass und Zeitzeugenberichten.

La tecnología de la traducción se utiliza ampliamente en casi todos los ámbitos en los que se identifican necesidades multilingües, al menos en entornos comerciales. Curiosamente, las necesidades multilingües de las ONG que trabajan en el ámbito de las migraciones parecen haber caído en el olvido en lo que respecta a la tecnología de la traducción. Esta monografía surge con el objetivo de cubrir este vacío mediante una aproximación rigurosa a la tecnología de la traducción aplicada al ámbito de la migración en áreas como la implementación de la traducción automática, el apoyo a las tareas de posedición, la idoneidad de las plataformas de traducción basadas en la web, la percepción de los traductores sobre la tecnología y el flujo de trabajo de la traducción.

Aunque suele considerarse El Llano en llamas como punto de partida del cuento mexicano de la segunda mitad del siglo XX, también puede verse como la culminación de una serie de itinerarios que la cuentística del país emprendió a finales del XIX, desarrolló durante la lucha armada revolucionaria, se actualizó con el polémico transcurrir de las vanguardias, se polarizó con la política cultural revolucionaria y la entronización de la literatura comprometida durante el cardenismo, y arribó a un espacio de encuentro al generalizarse el desencanto provocado por el fracaso de la Revolución. Este libro explora esas rutas diversas e identifica sus figuras más representativas, algunas olvidadas, con el fin de contribuir a trazar el heterogéneo y rico campo que hizo germinar El Llano en llamas.

Este tomo estudia la mirada internacional de la Guerra Civil y el franquismo. El libro aborda testimonios, memorias, ficciones excéntricas, que incluyen textos olvidados, autores exiliados o la producción en otras lenguas, y los circuitos españoles extranjeros. Se presenta un estudio introductorio, seguido por 21 artículos en tres bloques. El primero indaga en la recepción del conflicto en la cultura americana, revisando el impacto en revistas, periódicos, antologías, libros y actividades culturales. En el segundo bloque se analiza la producción testimonial de reporteros de Gran Bretaña y Polonia, y la repercusión de la contienda en la prensa noruega. El tercero se centra en la mirada europea, abordando diferentes representaciones de escritores extranjeros.

Das Buch beschäftigt sich mit den Herausforderungen der Fremdsprachenforschung im Bereich der Aufgabenorientierung und empirischen Unterrichtsforschung. Ausgangspunkt vieler Beiträge ist die Auseinandersetzung mit den Arbeiten von Bernd Tesch, die sowohl die rekonstruktive Unterrichtsforschung wie auch die Aufgabenorientierung im Fremdsprachenunterricht beeinflusst haben. Dabei werden verschiedene Perspektiven aus Fremdsprachendidaktik, Erziehungswissenschaft sowie Literaturwissenschaft betrachtet und sowohl separat als auch in Beziehung zueinander diskutiert. In den Beiträgen werden aktuelle Forschungsthemen beleuchtet und sowohl konzeptionelle als auch empirische Aspekte der Aufgabenorientierung und Unterrichtsforschung untersucht. Aufgezeigt werden somit nicht nur die Potenziale sondern auch die Grenzen dieser beiden Bereiche und (aktuell noch offene) Forschungsfragen sowie Perspektiven für die Zukunft.

Dieser interdisziplinäre Sammelband geht den Möglichkeiten nach, die sich durch die intensive Erforschung eines Objekts (Grabkrone Konrads II. in Speyer) oder die Verbindung von Schriftquellen und anthropologischer Fundsituation (Philipp von Schwaben) ergeben. Er fragt nach Grabgestaltung und Grabdenkmälern, nutzt germanistische, epigraphische, mentalitätsgeschichtliche und Digital Humanities-Methodiken. Wie sterben Frauen in der mittelalterlichen Literatur, wie spricht man im Mittelhochdeutschen über den Tod? Und wie geht man damit um, wenn der Leichnam fehlt, weil der Kaiser fern seines Reiches in Kleinasien auf dem Kreuzzug verstirbt? Zusammen ergeben sich damit neue Perspektiven auf ein erforschtes, aber längst nicht erschöpfend verstandenes, allgegenwärtiges Phänomen des menschlichen Lebens: Unser Sterben.

The promotion of the conservation and sustainable use of forests is a crucial aspect of environmental protection. However, effective and legally binding international regulations specific to forests are still absent. The scope of this research is to analyse the existent international legal regime for forests and to elaborate approaches to the enhancement of its efficiency. The rigorous analysis of international documents leads, finally, to conclude that pure market-based mechanisms are not sufficient for the conservation of forests and stronger legally-binding provisions are needed. Based on these conclusions, the research proceeds with the analysis of possible ways of the development of international legal regime for forests, as well as the promotion of compliance with international treaties.

De forma assaz enfática, e muito consciente, o mundo medieval representa-se a si mesmo, nas suas múltiplas práticas sociais e estético-culturais, através da figuração animal. Pela mão de um assinalável conjunto de especialistas, esta obra faz-nos, assim, recuar a um tempo em que a realidade se inscrevia amplamente sob a égide representacional dos bichos; e, com isso, ajuda-nos a compreender, nós que vivemos em tempos de notória inquietação pelo vivente e de empatia pró-animal, os limiares homem/animal durante a Idade Média central e tardia. Mas também, implicitamente, se revela fundamental para refletir sobre as razões pelas quais os séculos pós-medievais, em nome da Modernidade, foram apagando do seu imaginário esses limiares.

This book suggests a theoretical framework for the non-democratic and illiberal donors of foreign aid and tests the empirical support of this framework. It aims to examine the foreign aid motivation and preferences of non-democratic and illiberal countries. The study applies the quantitative methodology to understand why nondemocratic and illiberal regimes provide foreign aid and what affects their aid preferences. The findings show that the nature of the relationship between the government and the business elite influences both aid motivation and aid preferences in those countries.

The Futurists produced most conspicuous, creative, and diverse figures of sound in the Polish avant-garde. The book is a comparative study of the Polish Futurists' works presented against the backdrop of European literary practices of the time (Dadaism, Italian and Russian Futurism) and the Polish literary tradition (folk poetry, Young Poland). S¿niecikowska examines variations on symbolist "musicality," traces similarities between Polish Futurist word formation and Cubo-Futurist experimentation, compares Dadaist and Futurist concepts of onomatopoeia, analyses applications of Marinetti's "words in freedom." The study also deals with uses of glossolalia and echolalia as well as sound-semantic concepts that employ pure nonsense and parody.

Dans le cadre du programme InterCompréhension Européenne (ICE), les apprenants acquièrent des compétences stratégiques qui leur permettent d'accéder à la compréhension de textes dans une langue a priori inconnue. Le déchiffrement de textes communique à l'intercompreneur novice non seulement des compétences lexicales, mais aussi un premier ensemble de compétences grammaticales de base, accumulé en l'absence d'une description de la grammaire fournie par l'enseignant moniteur. Le protocole proposé prouve que l'émergence naturelle d'une grammaire pratique en ICE est tout à fait plausible et surtout qu'elle est compétitive par rapport à une grammaire exposée de manière traditionnelle.

Jerzy Franczak comprehensively presents Jacques Rancière's thought by emphasizing the relationship between politics and literature. This detailed analysis takes into account the context of modern aesthetics and political philosophy, as a result, the book introduces further protagonists such as Louis Althusser, Michel Foucault, Pierre Bourdieu, or Jean-François Lyotard. Franczak first reconstructs Rancière's original philosophy of literature and subsequently apply it in readings of select world literature masterpieces by Gustav Flaubert, Max Jacob, Bertold Brecht, Vladimir Nabokov, and Philip Roth.
