The first question you ask the attorney is, "am I in a contractual relationship that allows this person to sue me for this act on my part?"

The third question you ask, "is there informed consent such that although the injury happened, it was a risk that the patient accepted prior to my treatment?"

The fourth question you ask, "is there negligence on my part sufficient to support a judgment against me?"

If you are in the chain of command the fifth question you ask is, "am I involved sufficiently as an administrator to support a judgment against me on the basis of Respondeat Superior?"

Having read the above if you are in the chain of command in a governmental agency the sixth question you ask is, "am I protected by governmental immunity or at risk?"
